BavAR[t] privacy policy

AR[t] Studio, the official editor of the BavAR[t] application is really concerned about the protection of the personal data and privacy of its users. This Privacy Policy below describes how AR[t] Studio collects and processes data about you in connection with your use of the BavAR[t] application.

1. What is personal data?

Personal data means any information relating to an identified or identifiable natural person (the "data subject").

In the context of the BavAR[t] application, the data subjects are the users of the platform.

The personal data concerned by this Privacy Policy are therefore all data relating to these users, insofar as they are identified or identifiable, for example by means of their user account identifier.

In Europe, the processing of personal data is subject to a specific legal and regulatory framework, constituted for France essentially by the European General Data Protection Regulation, known as "GDPR" and the law known as "Informatique et Libertés" of January 6, 1978. BavAR[t] complies with all these European regulations.

Underage children: The GDPR specifies that persons under 15 years of age are considered as underage for the purpose of collecting personal data. Minors must have the consent of a legal representative for their data to be collected, processed and used.

2. What personal data is collected, for what purposes, and on what legal basis?

AR[t] Studio collects personal data about its users in the following cases, for the following purposes:

2.1 When you register as a user on the BavAR[t] application

When you create your account on the BavAR[t] application, AR[t] Studio collects the following data:

  • • Your email ;
  • • Your password ;
  • • Your username ;
  • • Your profile picture (optional) ;
  • • Your biography (optional) ;
  • • Your professional activity (optional).



Only the username, email and password are required to use the application. The other fields can be left blank or modified at the user's discretion.

These data are collected and processed for the purpose of managing your user account and allowing access to the features of the BavAR[t] application. This processing is based on the necessity of its implementation for the execution of a contract to which the user is a party, namely the general conditions of use of the BavAR[t] application.

2.2 When using / browsing the BavAR[t] application

When you connect to the BavAR[t] application, AR[t] Studio collects, through its servers, the following data:

  • • The IP address of your device ;
  • • Your device type and technical specification ;
  • • The version of your browser software and your device operating system ;
  • • URL (Instagram, Facebook, Artstation, Website) - Optional
  • • If you have given your consent :

          - your geolocation
          - camera usage (photo and video)
          - access to the image and video gallery of the device to upload photos and files to the application (AR[t] Studio obviously only collects the file you have chosen).



The URLs corresponding to the user's social networks can be left empty or modified at the user's discretion. This data is collected and processed for the purpose of enabling the use of all the features of the BavAR[t] application. This processing is based on the necessity of its implementation for the execution of a contract to which the user is a party, namely the general terms of use of the BavAR[t] application as well as your consent for the processing of your geolocation data and downloaded files.

2.3 When using the contact form

When you fill out the contact form of the BavAR[t] application, AR[t] Studio collects the following data:

  • • Your username
  • • Your email ;
  • • Your message.



In the case where you would enter in the message input field some data likely to be qualified as "sensitive data" according to the applicable regulation, such as for example data relating to your state of health, you explicitly agree, while clicking on the button of sending of the form, that AR[t] Studio can receive these data and treat them in order to answer you. It is clear that AR[t] Studio does not require nor incite its users to communicate data known as "sensitive" within the framework of these free zones of comments.

This data is collected and processed for the purpose of responding to your messages and queries. This processing is based on your consent. The messages sent will not be visible to other users.

3. Who is in charge of these personal data processing operations, and how to contact this team?

The team in charge of this processing is AR[t] Studio, official publisher of the BavAR[t] application.

For any question relating to this current Privacy Policy, to the processing of personal data implemented on the BavAR[t] application, or in general to the protection of personal data and privacy within AR[t] Studio, you can contact the controller at the following address: welcome@bavart.io.

4. With whom is the Data Shared?

The personal data collected and processed as described in Article 2 above, are used solely by the competent persons within AR[t] Studio.

They may also be shared with the company hosting our data : AWS Europe, but only to achieve the purposes described above.

5. How long is the Data Kept?

The personal data collected and listed are kept by AR[t] Studio and its possible subcontractors for periods not exceeding the achievement of the purposes described above.

6. Your Rights

In application of the laws and regulations applicable to the protection of personal data, you have the following rights concerning the processing of your personal data.

You can exercise them by contacting AR[t] Studio at the following address: welcome@bavart.io.

These rights being purely personal, and being able consequently to be exerted only by the concerned person.

6.1 Access Rights

The user can have access to his personal data treated by AR[t] Studio. In the hypothesis where request would be made to him, AR[t] Studio will thus provide to the user a copy of all his personal data as well as all the legally required information, namely:

  • • Categories of personal data collected and processed ;
  • • Purposes of data processing ;
  • • Categories of recipients to whom the personal data have been communicated or are likely to be communicated ;
  • • Retained period of time of personal data; and
  • • Information about the user's rights with respect to his personal data.


6.2 Portability Rights

For those, among the treatments listed in article 2 above, having for legal basis the consent of the user or their necessity for the execution of a contract, the user also has the right to the portability of his personal data.

This right differs from the right of access to personal data in that (i) it concerns only the data provided by the user to AR[t] Studio and (ii) it allows the user to obtain this data in a structured and machine-readable format.

The right to the portability of the personal data of the user opens in addition the possibility that they are transmitted to another controller, with the choice of the user, provided that it is technically possible.

6.3 Right of Rectification

The user can ask to correct his personal data if they are inaccurate, incomplete or obsolete. He can also correct his data directly on his account.

6.4 Right to Deletion

The user may request that his/her personal data be deleted in the following cases:

  • • if his/her personal data are no longer necessary for the purposes for which they were collected or processed;
  • • if the user has withdrawn his/her consent to the processing of his/her personal data, provided that his prior consent was the legal basis for their collection and processing and that there is no other legal basis for them;
  • • if the user has objected to the collection or processing of his/her personal data in accordance with Article 6.5 below;
  • • the processing of the user's personal data is unlawful;
  • • the user's personal data must be deleted in order for AR[t] Studio to comply with a legal obligation; or
  • • if the user was an underage child at the time of the collection of his personal data. For this last case of figure and provided that the user is minor at the time of the request, the holders of the exercise of the parental authority of the user can also formulate a request for suppression of his personal data near AR[t] Studio.



If the data concerned has been communicated to third parties, AR[t] Studio will inform these third parties of the user's request, as far as possible.

6.5 Right of Opposition

Subject to a legitimate justification relating to the particularity of his or her situation, the user may object to any processing of his or her personal data when his or her personal data are processed on the basis of the necessity of such processing for the performance of a task of public interest or the pursuit of the legitimate interest of AR[t] Studio or of a third party.

The user may also object, without any obligation to give reasons, to the processing of his or her personal data when this is done for the purpose of prospecting.

6.6 Right to Restrict Processing

The user can ask for the limitation of the treatment of his personal data in the following cases:

  • • in the event that he disputes the accuracy of his personal data, and this for the time necessary for AR[t] Studio to verify it;
  • • if the treatment of its personal data is illicit and that the user wishes to limit it rather than to ask for the suppression of these last ones;
  • • if the user wishes that AR[t] Studio preserves his personal data when those are necessary for the establishment, the exercise or the defense of his rights in justice; or
  • • if the user opposed the treatment of his personal data, during the period during which AR[t] Studio checks if it does not have other overriding legitimate reasons to continue their treatment.



AR[t] Studio will then cease to process the data concerned and will keep them for the appropriate period.

6.7 Right to define data disposition directives after death

The user can give to AR[t] Studio directives concerning the modalities of conservation, deletion and communication of his personal data to intervene after his death.

6.8 Right to Withdraw Consent

For all the treatments, among those listed in the article 2 above, having for legal base the consent of the user, this last one has the right to withdraw this consent at any time, without having to justify it to AR[t] Studio.

6.9 Right to file a complaint with a supervisory authority

The user has finally the right to introduce a complaint relating to the treatments implemented by AR[t] Studio near the competent authority of control.

For France, this authority of control is the National Commission of Data processing and Freedoms. For more information on this last and the means of contacting it, the user is invited to consult the site https://www.cnil.fr/.

7. Changes to this Privacy Policy

Users of the BavAR[t] application will be notified of any material changes to this Privacy Policy by a posting on the application and users will receive an informational email at the email address associated with their user account.
